DISTANCE SALES AND CANCELLATION AGREEMENT

By accepting this agreement, the BUYER acknowledges and accepts in advance that, upon confirming the order, they will be liable for the advance payment and any additional charges such as taxes, and has been informed accordingly.
DEFINITIONS
For the purpose of implementing and interpreting this Agreement, the terms written below will have the following meanings:
SERVICE: Refers to any consumer transaction performed or promised to be performed for a fee or benefit.
SELLER: The company that provides goods or services to the consumer, or acts on behalf of or for the account of the seller in its commercial or professional activities.
BUYER: A real or legal person who acquires, uses, or benefits from a good or service for non-commercial or professional purposes.
SITE: The website owned by the SELLER.
ORDERING PARTY: A real or legal person who requests a good or service from the SELLER via the website, verbal, or written communication channels.
PARTIES: Refers to the SELLER and the BUYER.
AGREEMENT: This agreement signed between the SELLER and the BUYER.
GOODS: Refers to the movable goods subject to purchase and immaterial goods such as software, sound, image, etc., prepared for use in an electronic environment.
SUBJECT
This Agreement regulates the rights and obligations of the parties regarding the services purchased by the BUYER from the SELLER’s website or through verbal or written communication channels.

PRODUCT/PRODUCTS INFORMATION SUBJECT TO THE AGREEMENT
The price information and detailed description of the medical procedure to be performed, along with accommodation and transportation options, will be sent to the BUYER’s email by the SELLER. This offer letter includes the price details, payment terms, the name of the medical procedure, accommodation, and transportation options.

GENERAL TERMS
8.1. The BUYER learns all the details of the service they will receive from the SELLER’s website or verbal or written communication channels. The BUYER acknowledges that these details, including all complications, have been communicated to them in detail.
8.2. All services under this Agreement will be provided at the location specified in the agreement between the SELLER and the BUYER. If it becomes impossible to provide this service for various reasons, the SELLER will offer alternative locations. If the SELLER cannot offer an alternative location due to physical impossibilities or if the BUYER refuses the alternatives, the agreement will terminate.
8.3. The SELLER will make every effort to provide the service as required. They will act with due diligence, integrity, and honesty.
8.4. If the SELLER cannot fulfill the service due to the impossibility of performance, they agree to notify the BUYER in writing within 7 days of learning about the situation, and return the total amount to the BUYER within 14 days.
8.5. The BUYER acknowledges that by confirming this agreement electronically, if for any reason the payment for the service is not made or canceled in the bank records, the SELLER’s obligation to provide the service will end.
RIGHT OF CANCELLATION
9.1. If the service desired by the BUYER cannot be provided due to various reasons, the SELLER will offer alternative locations. If the SELLER cannot offer an alternative location due to physical impossibilities or if the BUYER refuses the alternatives, the agreement will terminate. In such cases, the SELLER will refund the amount paid by the BUYER within 7 business days.
9.2. If the BUYER cancels the service for reasons not due to the SELLER’s fault, the SELLER will charge an advance payment for accommodation, transfers, and medical treatment services, as necessary for planning and making reservations. Therefore, 100.00 EUR (One Hundred Euros) of the amount collected from the BUYER will not be refunded by the SELLER. The remaining amount will be refunded to the BUYER.
9.3. If the BUYER cancels the contract without the SELLER’s fault, they must notify the SELLER in writing via registered mail, fax, or email.
DEFAULT AND LEGAL CONSEQUENCES
If the BUYER defaults on the payment by credit card, they accept, declare, and undertake to pay interest under the credit card agreement with the issuing bank and be responsible to the bank. In this case, the relevant bank may resort to legal means, request the costs and attorney fees from the BUYER, and in any case, if the BUYER defaults on the debt, they accept, declare, and undertake to compensate the damage and loss incurred by the SELLER due to the delayed payment.
COMPETENT COURT
In case of disputes arising from this agreement, complaints, and objections, the courts of AYDIN are competent.
